This is the latest announcement from DIAC, and it highly negatively affects the off shore skilled applicants
that their occupation is not in CSL (Critical Skilled List)
It says that it's unlikely that those cases be finalised any time earlier than 2011.See below for full details:
MINISTERIAL ANNOUNCEMENT
The Minister for Immigration and Citizenship, Senator Chris Evans (“the
Minister”) has set , under Section 499 Direction, processing priorities to most skilled migration visa applications. The Direction applies from 23 September 2009 to all Skilled-Graduate (Subclass 485) and Skilled Subclasses 487,885 and 886 visa applicants, including those in the final stages of processing.

The Direction gives the following processing priority to Subclass 485 visa applicants (with highest priority listed first):
1) applications from persons who have completed an Australian Doctor of
Philosophy (PHD) at an Australian educational institution in Australia;
2) applications from persons who have nominated an occupation on the
Critical Skills List (CSL);
3) applications from persons who have completed an Australian Bachelor
degree and Australian Masters degree at an Australian educational
institution in Australia;
4) applications from persons who have completed an Australian Bachelor
degree and Australian Honours degree (at least upper second class level)
at an Australian educational institution in Australia;
5) applications from persons who have completed an Australian Bachelor
degree or Australian Masters degree at an Australian educational institution
in Australia;
6) all other valid applications are to be processed in the order in
which they are received.

Other Subclasses 885, 886 and 487affected Under the section 499 Ministerial Direction, the following processing priorities (with highest priority listed first) apply:
(a) 1. applications from persons who are employer sponsored under the
ENS and the RSMS;
(b) 2. applications from persons who are nominated by a
State/Territory government and whose nominated occupation is listed on the Critical
Skills List (CSL);
(c) 3. applications from persons who are sponsored by family and whose
nominated occupation is listed on the CSL;
(d) 4. applications from persons who are neither nominated nor
sponsored but whose nominated occupation is listed on the CSL;
(e) 5. applications from persons who are nominated by a
State/Territory government whose nominated occupation is not listed on the CSL;
(f) 6. (i) applications from persons whose occupations are listed on
the Migration Occupations in Demand List (MODL); and
(g) (ii) applications from persons who are sponsored by
family and whose nominated occupation is not listed on the CSL;
(h) 7. all other applications are to be processed in the order in
which they are received.

The CSL is a list of occupations developed in response to the changing critical skills needs of Australia. The CSL can be found on the Department of Immigration and Citizenship’s (the Department’s) website at:
http://www.immi.gov.au/skilled/general-skilled-migration/pdf/critical-skills-list.pdf

If you are enquiring about the status of your visa application that has been affected by the new changes, the following information may be of assistance. Only enquiries about applications currently being processed will receive a further status update.

What will happen to those applications which are in the final stages of processing and where the Department has requested applicants to provide health and character clearances?
The new arrangements apply to ALL visa applications, including those in the final stages of processing. Please note your application cannot be progressed as it is reassigned according to the priority processing arrangements.

My application does not fall into one of the priority categories. When can I expect to have my application finalised?

If your nominated occupation is not on the CSL and you applied for an onshore GSM visa or intend to apply for an onshore GSM before the end of 2009, it is unlikely that your visa will be finalised before the end of 2011.

Your ‘nominated occupation’ is the occupation you nominated at the time you lodged your application and cannot be changed.

What are my options if my application is unlikely to be finalised by the end of 2011 and I have applied for an onshore visa?
The options available are:
• to continue to live and work in Australia (without restriction)
whilst you await a decision on your visa application,
• to consider your eligibility for an employer sponsored visa, or other
substantive visa, or
• to withdraw your application and return to your home country.

Please note, if you choose to withdraw your application you will not be entitled to a refund of your Visa Application Charge (VAC).

Where can I get further information?
Information concerning priority processing arrangements and other changes to General Skilled Migration visas is available on the Department’s website
at:
http://www.immi.gov.au/skilled/general-skilled-migration/whats-new.htm

Information on skilled visa processing is updated each week and can be
obtained by sending a blank email to: gsmb.information@immi.gov.au This
is an automated email
service.

*Please do not contact the Department to request your application be exempt from the priority processing Direction. Case officers must adhere to the Minister for Immigration and Citizenship’s priority processing Direction.

Kind Regards,
General Skilled Migration - Brisbane

Q9: What will happen to those applications which are in the final stages of processing and where the Department has requested applicants to provide health and character clearances?
The new arrangements apply to all visa applications, including those in the final stages of processing. Applications in lower priority groups cannot be processed further until those in higher priority groups are finalised in accordance with the priority processing Direction
